Drug Test Australia — Trade Account Terms

1. Eligibility & Application
Trade accounts are available to approved Australian businesses. Applications must be completed in full and may require supporting documentation (e.g. ABN/ACN, business letterhead, references). Approval is at the sole discretion of Drug Test Australia Pty Ltd (“we”, “us”). Submitting an application does not guarantee approval.
By applying for a trade account (online or offline), you agree to these Trade Account Terms, our Privacy Policy, and our Terms & Conditions of Sale.
2. Credit Assessment & Privacy
We may conduct credit and reference checks on your business and, where applicable, its directors/guarantors, as permitted under the Privacy Act 1988 (Cth). You consent to us obtaining and sharing information with credit reporting agencies and other credit providers to assess creditworthiness, recording account performance and defaults, and contacting your trade/banking references. We handle information per our Privacy Policy.
3. Account Approval & Use
Approved applicants will be notified in writing (usually by email). You are responsible for safeguarding login credentials and ensuring only authorised representatives place orders. Notify us immediately of any unauthorised access or misuse.
4. Payment Terms (Net 14)
Unless otherwise agreed in writing, trade credit accounts operate on Net 14-day payment terms from the invoice date. We may vary or withdraw credit terms at any time based on account conduct or credit reassessment.
Overdue accounts may incur: (a) interest up to 1.5% per month (or the maximum permitted by law, if lower); (b) reasonable administrative/recovery fees; and (c) suspension of supply or cancellation of open orders until the account is brought current. All invoices must be paid in full without set-off or deduction.
5. Title & Risk
Title to goods remains with Drug Test Australia Pty Ltd until payment in full is received. Risk passes on dispatch from our warehouse or collection by your nominated carrier (FOB). We may repossess unpaid goods in accordance with applicable laws.
6. Orders, Supply & Returns
All orders are subject to acceptance and availability. We may offer partial shipments or alternatives with your prior consent.
Returns and warranties are provided in line with our general Terms & Conditions and the Australian Consumer Law. Drug test kits and other perishables may only be returned if faulty and must be accompanied by proof of proper storage and handling.
7. Fees, Costs & Recovery
You agree to reimburse all reasonable costs incurred by us in recovering overdue amounts, including legal fees on a solicitor/client basis, court/bailiff/process-service costs, and debt-collection agency fees. These may be added to your account balance and are recoverable as a debt.
8. Personal Guarantee (for Companies)
If the applicant is a company, its director(s) personally guarantee all monies owed under the trade account. This is a continuing guarantee and remains in force until all obligations are fully discharged.
9. Suspension & Termination
We may review, suspend, or terminate trade accounts at any time (including for non-payment, misuse, inactivity, or credit risk concerns). You may close your account by written notice; any outstanding balances remain payable in full.
10. Indemnity & Limitation of Liability
You indemnify Drug Test Australia Pty Ltd against any loss, claim, or expense arising from your breach of these Terms, misuse of your account, or non-payment. To the extent permitted by law, our liability is limited to resupplying goods or refunding the purchase price.
11. Governing Law
These Trade Account Terms are governed by the laws of New South Wales, Australia. You submit to the jurisdiction of the courts of NSW and the Commonwealth of Australia.
