1) Website Terms of Use
1.1 Acceptance
By accessing or using this Website, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Website.
1.2 Changes
We may update these Terms and pricing at any time. Changes take effect when posted on this page. Your continued use of the Website means you accept the updated Terms.
1.3 Intellectual Property & Trademarks
Unless otherwise stated, all content on this Website (text, images, graphics, logos, videos) is owned by or licensed to Drug Test Australia Pty Ltd and protected by intellectual property laws. You are granted a limited, revocable license to view Website content for personal/business reference only.
- You must not copy, reproduce, republish, publish in media, distribute, modify, or post our content elsewhere without prior written consent.
- You must not data-mine, scrape or harvest Website content.
- All trademarks, logos and service marks are the property of their owners. No licence is granted.
1.4 Acceptable Use
- Do not use the Website in any unlawful, fraudulent, harmful or disruptive manner.
- Do not interfere with or attempt to gain unauthorised access to the Website or related systems.
- Do not upload or transmit malicious code.
- Do not use the Website to engage in advertising or marketing without our consent.
1.5 Product Information & Advice
Product information on the Website is general in nature and may differ from packaging or manufacturer updates. Always read and follow the manufacturer’s instructions and warnings. Website content does not substitute for professional medical advice.
1.6 No Warranties (Website)
The Website is provided “as is.” While we aim for accuracy and uptime, we do not guarantee that content is current, complete, error-free, or that the Website will be uninterrupted or secure.
1.7 Liability (Website)
To the extent permitted by law, we exclude liability for any indirect or consequential loss arising from your use of the Website. Nothing in these Terms limits any rights you may have under the Australian Consumer Law (ACL).
2) Sale of Goods & Services
2.1 Ordering & Acceptance
Your order is an offer to buy; we may accept or reject any order at our discretion (e.g., stock availability, payment issues, pricing errors).
2.2 Pricing, Errors & Variations
Prices are shown in AUD and inclusive/exclusive of GST as indicated. We may correct pricing, description, or listing errors at any time. If we correct an error after you order, we’ll contact you to confirm, amend, or cancel and refund.
2.3 Payment
Payment methods are shown at checkout. Where no approved credit account exists, payment is required prior to dispatch.
2.4 Delivery & Risk
Online store orders (consumer/retail): We ship Australia-wide (flat-rate shipping where advertised). Title and risk in goods pass on collection (FOB). Inspect deliveries promptly and notify us of shortages within 2 business days.
Trade / ex-warehouse shipments (customer-arranged carrier): Where goods are collected by, or delivered to, your nominated carrier, title and risk pass on collection (FOB). Transit insurance and charges are your responsibility.
Return freight: For change-of-mind returns accepted at our discretion, return freight is at the buyer’s cost. Where a manufacturer fault or recall applies, we will handle returns consistent with the ACL and supplier processes.
2.5 Delivery Delays & Force Majeure
We’re not liable for delays outside our reasonable control (e.g., carrier delays, strikes, pandemics, natural disasters). If affected, we’ll take reasonable steps to notify you and minimise impact.
2.6 Product Suitability & Compliance
You’re responsible for ensuring products are suitable for your intended use and that your organisation and staff are competent and trained to use them in accordance with manufacturer instructions and applicable standards (e.g., AS/NZS).
2.7 Warranty, Returns & Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies consumer guarantees under the ACL.
- Change of mind: We may, at our discretion, accept unopened, saleable items returned within 14 days (restocking fee may apply; freight at buyer’s cost).
- Faulty goods: If a product is faulty, we will provide a remedy in accordance with the ACL (repair, replacement, or refund).
- Drug test kits & perishables: Due to storage sensitivity, returns are only accepted where the issue relates to a fault or failure to meet consumer guarantees. Evidence of correct storage/handling in line with the product insert may be required.

2.8 Default & Recovery
If you fail to pay amounts due or enter administration, we may suspend or cancel outstanding orders. You agree to pay reasonable recovery costs (including third-party collection costs) incurred for overdue accounts.
3) Trade Accounts (Addendum)
3.1 Eligibility & Assessment
Trade accounts are available to approved businesses. Applications must be completed in full and may require supporting documents (e.g., ABN/ACN, business letterhead). Approval is not automatic and is at our discretion.
3.2 Pricing & Access
A trade account does not automatically include special pricing or discounts. Unless expressly agreed in writing, pricing is the same as our publicly listed website pricing. Any site-wide promotions or bulk discount tiers (if offered) apply as advertised to all customers. Approved trade customers may be granted access to Invoice / Pay on Account terms (subject to approval) and to account/order history when logged in.
3.3 Payment Terms
If we agree to invoice terms, standard terms are Net 14 days from the invoice date unless otherwise agreed in writing. We may withdraw terms or require prepayment at any time based on account conduct or credit risk. Overdue amounts may incur late fees/interest (up to 1.5% per month, or the maximum permitted by law) plus reasonable recovery costs.
4) Indemnity
To the extent permitted by law, you agree to indemnify us for losses, costs, or liabilities arising from your breach of these Terms or misuse of the Website or products, except to the extent caused by our negligence or breach.
5) Assignment
We may assign, transfer or subcontract our rights and/or obligations under these Terms without notice. You must not assign, transfer or subcontract your rights and/or obligations without our prior written consent.
6) Complaints & Communications
If you are concerned about our products, services, or how we have handled your personal information, contact sales@drugtestaustralia.com.au. We will acknowledge your complaint and outline next steps. You may give us instructions or enquiries via our contact form or email; in some cases, we may require instructions in writing.
7) Severability
If any part of these Terms is invalid or unenforceable, the remainder remains in force.
8) Entire Agreement
These Terms, together with any legal notices and disclaimers on this Website, constitute the entire agreement between Drug Test Australia and you regarding your use of the Website and sale of goods/services, and supersede all prior understandings to the extent permitted by law.
9) Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.
